Backup Service Agreement

This Backup Service Agreement (“Agreement”) regulates the backup conditions, rights, and obligations related to the services provided by MODESER - Modern Design Services.

This agreement is an inseparable part of the main service agreement provided by MODESER and becomes effective once the customer places an order and completes the payment process.

Article 1 - General Provisions

• The responsibility for data security and regular backups belongs entirely to the customer for all hosting-related services.
• The customer is responsible for maintaining regular backups of files, databases, emails, licenses, and all other digital content.
• Backup services provided by MODESER are auxiliary services only.
• MODESER shall not be held liable for data loss caused by hardware failures, software issues, cyber attacks, user errors, corruption, natural disasters, or force majeure events.
• Subject to applicable Turkish laws and regulations, MODESER shall not be liable for data loss, profit loss, or indirect damages.

Article 2 - Backup Policy for Hosting Services

• The customer is solely responsible for maintaining backups in Web Hosting, WordPress Hosting, Reseller Hosting, and similar services.
• MODESER may perform automatic backups for operational purposes; however, such backups are not guaranteed.
• Free backups are not guaranteed to be complete, consistent, or restorable.
• The customer must maintain independent backups on local or external systems.
• Unless an additional “Professional Backup Service” is purchased, MODESER has no obligation to retain or restore customer data.
• Data may be permanently deleted in cases of overdue payments, service cancellation, or account termination.

Article 3 - Paid Backup Service

• MODESER may offer professional backup services for certain products at an additional fee.
• Even if a paid backup service is purchased, the customer remains responsible for keeping independent backups.
• MODESER accepts no liability for corrupted, incomplete, or non-restorable backups.
• MODESER shall not be responsible for data loss, software issues, or configuration problems occurring during restoration processes.
• MODESER reserves the right to modify backup policies and retention procedures when necessary.

Article 4 - Customer Responsibilities

• The customer is legally responsible for all hosted content.
• MODESER reserves the right to suspend services containing illegal content, malware, or activities threatening server security.
• Any legal or financial liabilities arising from customer activities belong solely to the customer.

Article 5 - Final Provisions

• This agreement becomes effective electronically upon approval.
• MODESER reserves the right to modify this agreement when necessary.
• Disputes arising from this agreement shall be governed by the laws of the Republic of Türkiye, and Ankara Courts and Enforcement Offices shall have jurisdiction.
